1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the ScrapTrade platform, operated by ScrapTrade ("we", "us", or "our"), accessible at scraphobart.com (the "Platform").
By registering an account or using the Platform in any way, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
2. Eligibility
To use ScrapTrade, you must:
- Be at least 18 years of age.
- Provide accurate and complete registration information.
- Have the legal capacity to enter into a binding contract in your jurisdiction.
- Not be located in a country subject to international trade sanctions that would prohibit use of the Platform.
- Not be a person or entity on any applicable sanctions or prohibited parties list.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately at support@scraphobart.com if you believe your account has been compromised.
- You must provide accurate, current, and complete information when registering and keep it updated.
- Only one account is permitted per person or legal entity. Duplicate accounts may be suspended.
- You are responsible for all activity that occurs under your account.
4. Seller Obligations
As a seller on ScrapTrade, you agree to:
- List only scrap material that you own or have legal authority to sell.
- Provide accurate descriptions, photographs, and quantity information in your listings.
- Complete the video verification process honestly — the video must show the actual material at its actual location.
- Fulfil orders within the timeframe specified on the listing or as agreed with the buyer.
- Respond to buyer enquiries and order-related communications within 48 hours.
- Not cancel an order after payment has been received except in genuinely exceptional circumstances.
- Comply with all applicable export laws and regulations in your country.
5. Buyer Obligations
As a buyer on ScrapTrade, you agree to:
- Complete payment within 48 hours of winning an auction or accepting a fixed-price purchase.
- Arrange logistics in accordance with the incoterm specified on the listing.
- Comply with all applicable import laws, duties, and regulations in your country.
- Confirm delivery honestly — only confirm when the goods have arrived and are as described.
- Raise any disputes promptly and in good faith within 48 hours of delivery.
- Not place bids on listings you do not intend to purchase.
6. Prohibited Items
The following items are strictly prohibited from being listed on ScrapTrade:
- Stolen goods or materials obtained through illegal means.
- Hazardous waste (including asbestos, PCBs, or other regulated substances) without valid documentation, permits, and compliance with all applicable regulations.
- Materials protected under CITES (Convention on International Trade in Endangered Species).
- Explosive materials, munitions, or weapons of any kind.
- Radioactive materials.
- Materials subject to active recall orders or safety bans.
- Any item that violates applicable local, national, or international law.
Listing prohibited items will result in immediate account suspension and may be reported to the relevant authorities.
7. Platform Fees
ScrapTrade charges a platform fee of 1% of the final transaction value on completed sales. This fee is charged to the seller only. There are no fees for buyers.
The platform fee is calculated as follows:
Platform Fee = Final Sale Price × 0.01
Example: $10,000 sale → $100 platform fee → $9,900 payout to seller
The fee is automatically deducted from the Stripe escrow balance before payout. There are no monthly fees, listing fees, or subscription charges.
8. Payment Terms
- All payments on ScrapTrade are processed via Stripe, Inc. By using the Platform, you also agree to Stripe's Terms of Service.
- Buyer funds are held in Stripe escrow after payment and are not released to the seller until delivery is confirmed.
- Payment is released to the seller after the buyer clicks "Confirm Delivery", or automatically 14 days after the recorded shipping date if no dispute is raised.
- Refunds are available only where the seller has materially misrepresented the goods. Refunds for change of mind are not available after payment.
- In the event of a successful dispute, refunds are processed to the original payment method within 5–10 business days.
9. Dispute Resolution
Either the buyer or the seller may raise a dispute from the order detail page in the Platform. The following process applies:
- 1Disputes must be raised within 48 hours of confirmed delivery (or the expected delivery date, if delivery was not confirmed).
- 2Our support team will acknowledge the dispute within 24 hours.
- 3Both parties will be asked to provide evidence — photographs, correspondence, and any relevant documentation.
- 4Our team will review all evidence and issue a binding decision within 5 business days.
- 5Outcomes may include: full payment released to seller, full refund to buyer, or a partial refund negotiated between both parties.
10. Intellectual Property
You retain ownership of all content you upload to the Platform — including photos, videos, descriptions, and messages ("User Content").
By uploading User Content, you grant ScrapTrade a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute your User Content on the Platform for the purpose of operating the marketplace. This licence ends when you delete your listing or account.
All ScrapTrade branding, software, design, and proprietary features are owned by ScrapTrade and protected by applicable intellectual property law. You may not copy, modify, or distribute any part of the Platform without our prior written consent.
11. Disclaimers & Limitation of Liability
ScrapTrade is a marketplace platform. We are not a party to transactions between buyers and sellers. We do not guarantee the quality, safety, legality, or accuracy of listings, nor the ability of sellers to sell or buyers to pay.
The Platform is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, ScrapTrade shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of profits, data, or goodwill. Our total liability to you for any claim arising from these Terms shall not exceed the platform fees paid by you in the 12 months preceding the claim.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Tasmania, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tasmania, Australia, unless alternative dispute resolution is agreed between the parties.
